MOTORISTS caught smoking while children and young people are in the vehicle face having to cough up a £100 on-the spot fine.

The Scottish Government passed legislation to give further protection to children from the effects of second-hand smoke.

When the law comes into force next month, anyone caught smoking in a private vehicle carrying an under-18 will face a fixed penalty notice of £100 or a court fine of up to £1000.

Public health minister Maureen Watt, said: “The purpose of this legislation is ultimately to achieve culture and behaviour change.

“Scotland has led the way with the ban on smoking in public places, the display ban and our commitment to a tobacco free generation – these have had a positive effect on public health and we are confident that a ban on smoking in cars with children will do likewise.”
